Terms of Service

These Terms govern your use of Festinato (the "Service"). By signing up you agree to them, the Privacy notice and the Data Processing Agreement.
1. The Service
Festinato provides a multi-tenant SaaS for running a festival — a white-label mobile app, an Odoo back-office, and a public REST API. Tier limits and pricing are at /pricing.
2. Account & tenant
You provide a tenant slug (matching
^[a-z0-9-]{3,32}$) and an admin email at
sign-up. The slug is your subdomain, your Postgres database
name and your push-topic identifier. You are responsible for
keeping the admin password confidential.
3. Subscription & payment
Subscriptions are billed annually in CHF through Mollie at the tier price posted on /pricing. Year one is paid up front via Mollie's hosted checkout; the recurring subscription begins twelve months later. Any one-time setup fee is included in the first year's invoice. Invoices are issued by Festinato from Odoo.
4. Cancellation
You can cancel at any time from your Mollie customer portal or by emailing support@festinato.app. The subscription stops at the end of the current paid year; we don't refund the unused portion.
On cancellation your tenant is moved to suspended
status. The back-office becomes read-only and the data is
retained for 90 days so you can recover or
export it. After 90 days the database, filestore and backups
are permanently deleted (see the
DPA §7).
5. Acceptable use
You agree not to:
- upload content you do not have the rights to;
- use the Service to send unsolicited bulk messages (push notifications must be relevant to a registered device's festival subscription);
- probe, scan or otherwise test the Service for vulnerabilities without prior written permission;
- attempt to access data belonging to other tenants.
6. Service availability
We target 99.5 % monthly uptime on the Starter / Community tiers and 99.9 % on Professional / Enterprise, measured on the public API. Scheduled maintenance windows are announced at least 48 hours in advance. There is no service credit for unmet targets on Starter / Community; Enterprise customers receive credits per a separate SLA.
7. Liability
To the extent permitted by Swiss law, our aggregate liability for any claim arising out of the Service is limited to the fees you paid in the preceding twelve months. We are not liable for indirect or consequential damages, including loss of revenue, profits or data, except in cases of gross negligence or intent.
8. Changes
We may update these Terms; we'll email the registered admin at least 30 days in advance of material changes. Continued use after the change date constitutes acceptance.
9. Governing law & venue
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Exclusive venue is the ordinary courts of the Canton of Solothurn, subject to mandatory consumer-protection laws of your residence.
